BLACK FRIDAY SWEEPSTAKES

 

1. SWEEPSTAKES PERIOD: The Black Friday Sweepstakes (the “Sweepstakes”) begins at 10:00 p.m. Eastern Time (“ET”) on November 28, 2024, and ends at 10:00 a.m. ET on December 2, 2024 (“Sweepstakes Period”).

1. ELIGIBILITY: Sweepstakes is open to legal U.S. residents that are at least eighteen (18) years old at the time of entry, and consent to and get signed up for MADE Hoops marketing emails (“Participants”). Sweepstakes is void in states and jurisdictions where prohibited by law. Directors, employees, officers, and the immediate family (spouse, parent, sibling, children, step-children, grandparent or grandchildren and their respective spouses, regardless of where they reside) and/or household members, whether or not related, of individuals employed by MADE Hoops, LLC (“Company”, or “Organizer”), and the Company’s respective parents, affiliates, subsidiaries, licensees, sponsors, promotional partners, prize suppliers, and advertising and promotional agencies, are ineligible to participate. By participating, entrants agree to be bound by these official rules (“Official Rules”) and the decisions of Sponsor, which are binding and final on matters relating to this Sweepstakes.  The Sweepstakes is subject to all applicable federal, state and local laws.

1. TO ENTER: The Sweepstakes is comprised of one (1) drawing (the “Drawing”) from Company’s website of Participants that consent to and sign up to receive Company’s marketing e-mails (“Emails”) during the Sweepstakes period. Participants that have signed up for Emails prior to the Sweepstakes period must sign up again during the Sweepstakes period to be eligible. During the Sweepstakes Period, Participants may participate in the Drawing by going to the Company website (www.madehoops.com) (“Website”) or logging into the MADE Hoops App (“App”) and fully completing the requested information and submitting the provided entry form for the Drawing. All entries must be received by Company by no later than 10:00 a.m. ET on December 2, 2024.  Limit of one (1) entry per person/email address.  Entries received from any person/email address in excess of the stated limitation will be void.  Entries generated by mechanical, script, macro or other automated means or by any means which subvert the entry process are void. All entries become the property of Company and will not be acknowledged or returned.  

1. SELECTION OF WINNERS: The Drawing will be held on or about December 3, 2024, after the close of the Sweepstakes Period. Potential winners will be selected at random from among all eligible entries received for the Drawing and notified by email. Any potential winner who cannot be contacted by the deadline stated in the initial notification will be disqualified and another potential winner will be selected for the Drawing, time permitting. The potential winners must comply with all terms and conditions of these Official Rules, and winning a prize is contingent upon fulfilling all requirements. The potential winners may be required to sign and return an Affidavit/Declaration of Eligibility and/or Liability/Publicity Release within such time period specified in the prize notification in order to claim the prize and become an official winner (“Official Winner”). If a prize notification is returned as undeliverable, a potential winner cannot be contacted or, if applicable, fails to sign and return the Affidavit/Declaration of Eligibility and Liability/Publicity Release within the required time period, or is not in compliance with these Official Rules, such potential winner may be disqualified and will therefore forfeit the prize. If a potential winner is disqualified for any reason, Company may award the prize to an alternate potential winner by random drawing from among all remaining eligible entries received, time permitting. Odds of winning depend on the total number of eligible entries received for the Drawing. 

1. PRIZES: A total of three (3) official winners (each an “Official Winner”) will receive one of the following prizes: (A) $1,000 via PayPal; (B) $500 Company Gift Card that may be redeemed on Company website; or (C) a merchandise package of $250 (as offered by Company at Company’s sole discretion). Total ARV of all prizes: $1,750. Limit of one (1) prize per Official Winner for the entire Sweepstakes.

ADDITIONAL TERMS.  Official Winners will not receive difference between actual value and ARV.  There will be no substitute to the prizes above and Company shall have no further obligation to any Official Winner that rejects or cannot receive the prizes above for any reason, except as in Company’s sole discretion.  Official Winners agree to abide by any terms, conditions and restrictions provided by law or on Company website.

 

Prizes are awarded “as is” with no warranty or guarantee, either express or implied. Official Winners will be responsible for all federal, state and local taxes and fees and other costs and expenses associated with prize receipt and/or use that are not expressly included in the prize description, including but not limited to any bank fees, taxes, etc. No cash or other substitution, assignment or transfer of a prize is permitted, except by Company, who reserves the right to substitute prize or prize component with cash or another prize of comparable or greater value. All prize details are at Company’s sole and absolute discretion.

 

1. PUBLICITY: Except where prohibited, participation in the Sweepstakes constitutes consent from each Official Winner for Company and its parent, subsidiary and affiliated companies and their respective designees to use the Official Winner’s name, likeness, photograph (including profile photo), voice, opinions, biographical information, hometown and state for advertising and promotional purposes, in any manner, in any and all media, now or hereafter devised, worldwide in perpetuity, without further payment or consideration, notification or permission.

1. PRIVACY POLICY: The personal information collected/provided in connection with this Sweepstakes will be used in accordance with Company’s Privacy Policy found at [INSERT LINK TO PRIVACY POLICY FROM WEBSITE]. Entrants who provide their email address will automatically be enrolled to receive emails from or on behalf of Company and can opt out of receiving future emails at any time by following the directions provided in such emails.

1. GENERAL CONDITIONS: The Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries, emails, or other communications of any kind, or for postage-due, damaged or illegible mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, or in any Sweepstakes-related materials. The Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. The Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer or other device related to or resulting from participating in this Sweepstakes or downloading materials from or use of the Website or App. Company reserves the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor impairs the integrity of the Sweepstakes, as determined by Company in its sole discretion. In such event, Company reserves the right to award the prizes at random from among all non-suspect, eligible entries received up to the time of the impairment or as otherwise deemed fair and appropriate by Company. Company reserves the right in its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner and void all associated entries. Any attempt by any person to deliberately damage any website or platform or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law, and, should such an attempt be made, Company reserves the right to seek damages and other remedies (including, without limitation, attorneys’ fees) from any such person to the fullest extent permitted by law. Company’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.

1. RELEASE/LIMITS OF LIABILITY: By entering this Sweepstakes, all participants (including all Official Winners) agree to release and hold harmless Company, its respective parents, affiliates, subsidiaries, and each of its respective officers, directors, shareholders, agents, employees and all others associated with the development and execution of this Sweepstakes (collectively, “Released Parties”) from and against any losses, damages, rights, claims or causes of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Sweepstakes or resulting directly or indirectly, from acceptance, possession, use, or misuse of the prize awarded in connection with the Sweepstakes (including any travel or activity related thereto), including without limitation personal injury, death and/or property damage, as well as claims based on publicity rights, defamation and/or invasion of privacy.

1. DISPUTES: Each entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or the prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Southern District of New York or the appropriate New York State Court located in New York, New York; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes and in no event will entrant be permitted to obtain attorneys’ fees or other legal costs; and (iii) under no circumstances will entrants be permitted to obtain awards for and entrants hereby waive all rights to claim punitive, incidental, indirect, special and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO ALL OR SOME OF THE ABOVE MAY OR MAY NOT APPLY TO YOU DEPENDING ON THE JURISDICTION. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Company in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.

1. WINNER LIST: For the names of the winners, send an email to [INSERT EMAIL ADDRESS FOR CUSTOMER SERVICE] with “Black Friday Sweepstakes Winners List” (or similar) in the subject line no later than fourteen (14) days after the end of the Sweepstakes Period.  Company will respond to such request in no less than fourteen (14) business days and will provide the first name and last initial of the winners.
